Waiver of Liability and Hold Harmless Agreement *

In consideration of receiving permission to ride ATV/motorcycles (but not limited to) on the property owned by Carl Meeks LLC, better known as 65 acres +/- at 532 Carl Meeks Rd, Rocky Point, North Carolina, hereinafter the “PROPERTY”, I hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE the following:	
Carl Meeks, LLC, Chad E. Hogston, Thomas Gerald Clifford, Michael Colin Hackman, Kyle Genaro Phillips and their assigns, heirs and spouses, hereinafter “OWNERS”
From any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury or death that may be sustained by me, or any property belonging to me, while participating in such activity, while in, on or upon the premises where the activities are being conducted, REGARDLESS of whether SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF THE OWNERS, or otherwise, to the fullest extent allowed by law.
I further AGREE TO INDEMNIFY AND HOLD HARMLESS the OWNERS from any loss, liability, damage, or costs, including court costs and attorneys’ fees that OWNERS may incur due to my participation in said activities, WHETHER CAUSED BY NEGLIGENCE OF OWNERS or otherwise, to the fullest extent allowed by law.
It is my express intent that this WAIVER and HOLD HARMLESS AGREEMENT shall bind the members of my family and spouse, along with my heirs, assigns and personal representatives. I further agree that any action must be filed in the State of North Carolina. Any portion of this document deemed unlawful or unenforceable is severable and shall be removed without any effect on the enforceability of the remaining provisions.
IN SIGNING THIS AGREEMENT, I ACKNOWLEDGE and REPRESENT THAT I have read this document, I understand it, and sign it voluntarily.  I am at least 18 years old and fully competent, and I execute this Agreement for full, adequate and complete consideration fully intending to be bound by the same.
I acknowledge that this is inherently a dangerous activity, with extreme consequences of property damage, personal injury, and possibly death.  I assume the risk involved in this activity, and I take full responsibility for my actions while on the PROPERTY.

RELEASE AND WAIVER OF LIABILITY, COVENANT NOT TO SUE
AND INDEMNITY AGREEMENT (for an adult 18 years and older)
 I, (Participant signing this agreement) fully
understand that recreational riding of all terrain vehicles is a potentially dangerous
activity. I wish to participate in these activities at the Copperhead MX Course and Ranch owned by Carl Meeks LLC in
Pender County North Carolina knowing that they are dangerous. I accept and
assume all risks of injury or death to me or my property and I represent and warrant that I
have the authority to provide this Release, and certify as follows:
To the fullest extent allowed by law, I HEREBY FOREVER RELEASE
AND DISCHARGE Carl Meeks LLC, its members, directors, officers,
employees, and anyone providing land for their use, their agents, heirs, or
spouses (Releasees) FROM ANY LIABILITY to the undersigned, my
personal representatives, assigns, heirs, and next of kin (Releasors) for any
loss or damage and any claim or demands therefore on account of injury to
the person or property of the undersigned or resulting in the death of the
undersigned, WHETHER CAUSED BY THE ACTIVE OR PASSIVE
NEGLIGENCE OF THE RELEASEES OR ANYONE while the
undersigned is participating in any activity arranged or sponsored by the
Releasees. I understand and acknowledge that recreational riding of all
terrain vehicles has inherent dangers, which no amount of care, caution,
instruction nor expertise can eliminate. I VOLUNTARILY ASSUME
FULL RESPONSIBILITY FOR ALL RISKS OF PERSONAL INJURY,
DEATH AND PROPERTY DAMAGE SUSTAINED WHILE
PARTICIPATING IN ANY TYPE OF RECREATIONAL RIDING OF
ALL TERRAIN VEHICLES ACTIVITIES, INCLUDING THE RISK OF
PASSIVE OR ACTIVE NEGLIGENCE ON THE PART OF THE
RELEASED PARTIES OR HIDDEN, LATENT OR OBVIOUS
DEFECTS AT ANY PROPERTY MADE AVAILABLE TO OR BY THE
RELEASEES FOR SAID ACTIVITIES.
To the fullest extent allowed by law, I WAIVE ANY RIGHT TO
PRESENT ANY LEGAL CLAIM OR SUIT against the Releasees,
whether based on negligence, breach of contract, breach of warranty, strict
product liability, dangerous condition of property, or any other legal
theories.
To the fullest extent allowed by law, IT IS THE EXPRESS INTENT OF THE PARTIES
THAT I FURTHER AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS
the Carl Meeks LLC, their members, officers, directors,
employees, or anyone providing land for their use, their agents, heirs, spouses, officers,
directors from any and all claims, suits, costs or expenses of any kind including attorney
fees and expert and consultant fees incurred as a result made by any person for personal
injury, including death or property damage, which claim in any way arises out of or is in
any way related to my participation with any recreational riding of all terrain vehicles
activities or any activity upon land made available for any recreational riding of all
terrain vehicles activities including patent or latent defects REGARDLESS OF FAULT
AND WHETHER OR NOT CAUSED BY THE ACTIVE, PASSIVE, OR SOLE
NEGLIGENCE OF THE INDEMNITEES. This obligation to defend, indemnify and hold
harmless equally binds my heirs, assigns and personal representative in the event of my
death or incapacity.
This document is a legally binding contract, which supersedes any other
agreement, or representation by or between the parties and which is
intended to provide a comprehensive Release of liability and agreement
not to sue.
The undersigned further expressly agrees that the foregoing Release and
Waiver of Liability, Covenant Not to Sue and Indemnity Agreement is
intended to be as broad and inclusive as permitted by the law of the State
of North Carolina and that if any portion is held invalid, it is agreed that
the balance shall, notwithstanding, continue in full legal force and effect.
THE UNDERSIGNED HAS READ AND VOLUNTARILY SIGNS THE
RELEASE AND WAIVER OF LIABILITY, COVENANT NOT TO SUE
AND INDEMNITY AGREEMENT and further agrees that no oral
representation, statements or inducements apart from the foregoing written
agreement have been made. The undersigned further agrees that should
any dispute arise between the parties arising from or relating to this
Release and Waiver of Liability, Covenant Not to Sue and Indemnity
Agreement, that the undersigned agrees to have the matter submitted to
arbitration and waives any right of trial by jury.

1. You acknowledge that you and any minors in your care that are operating Dirtbikes/ATVs,
hereinafter "Machines", are competent and knowledgeable about how to operate said
machines. You and any minor under your care are not beginners, having never operated a
machine. You understand and are well-versed in the machine you are riding, and understand its
potential AND its limitations.

2. Before riding any of our tracks/trails, you will do a "Site Lap". A Site Lap is at least one full lap
around the track/trail at a slow speed, looking for obstacles, dangers and hazards on the course.
This will assure that you have reviewed the area you are riding, and are fully aware of the
terrain and potential hazards.

3. If upon review you see a hazard or obstacle that looks unsafe or unusual, DO NOT ride in that
location. Contact the owners immediately so that the area of concern can be fixed or blocked
off until repair.

4. Please follow the directional signs on the tracks/trails. They are one-directional.

5. Absolutely no alcohol or controlled substance consumption while riding machines.

6. Do not ride beyond your ability, do not ride features that make you uncomfortable, do not
"show off". This is how accidents occur.

7. If you are tired, take a break. Riding tired raises the possibility of accidents.

8. No Four-Wheelers, ATVs, Side X Sides, three-wheelers on the tracks. They are for dirtbikes only.

9. You must wear a helmet and boots at all times while riding. A chest protector, goggles, gloves
and neck brace are advisable as well.

10. Make sure your machine is in working order and fueled up.

11. Do not turn on the irrigation system

12. Do not go outside our property lines.

13. Please respect our neighbors to the fullest extent. All of our neighbors are good folks, so treat
them like they are your neighbors.

14. No riding before 8:30am. Also, do not ride after dark.

15. No unauthorized riders or guests. That means people with you that have not executed the
proper documents.

16. There is a small group of people that have authorization to ride the property during reasonable
hours. Please respect them, as they will also respect you. This group of people are seasoned
riders, very knowledgeable, and are super nice. We do not have any reckless people, or
"Cowboys" riding our property. It is family-oriented.

17. You acknowledge that violation of any of these rules subject you to being removed from the
property. You also agree that violation of these rules, or any other common sense guidelines,
equate negligence on your part. We will ask you to leave if you can't follow these rules.

18. Lastly, sorry about all of the above-listed rules! We want you to enjoy your stay, and have fun on
what we have, and continue create at Copperhead. It's a special place, and we want you to
have a good experience and tell others. We continue to add amenities to the property.

I understand that all ATV MOTOCROSS AND THE OPERATION OF ANY MOTORIZED VEHICLE must stay on 532 Carl Meeks Rd property and the marked trails on the property. If tenants break this rule, tenants are subject to eviction without refund. Thanks for following this rule. *
